Privacy Policy
Effective Date: August 1, 2026. This Privacy Policy explains how Crash.Help collects, uses, and discloses information about you when you visit Crash.Help, use our services, or communicate with us. Please read it together with our Terms of Service.
1. Who We Are and What We Are Not
Crash.Help is a consumer information and connection service for people involved in motor vehicle accidents in Florida. We are not a law firm, we do not provide legal advice, and using the Services does not create an attorney-client relationship with us.
We are not a lawyer referral service and we are not endorsed by, affiliated with, or approved by The Florida Bar. We are a qualifying provider within the meaning of Rule Regulating The Florida Bar 4-7.22. Attorneys and service providers who participate in our network pay us a fee. See Section 6.
We are not an insurance company, adjuster, public adjuster, or broker, and we do not provide medical care or advice.
2. We Do Not Contact Accident Victims
Every connection begins with you. We do not obtain crash reports, we do not purchase or use data derived from crash reports or motor vehicle records, and we do not call, text, mail, or otherwise contact people because they were involved in an accident. We advertise to the public. If you reach out to us, we respond. If you do not, you will not hear from us.
3. Information We Collect
Information you provide.
- Contact and account information: name, email address, telephone number, mailing address or ZIP code, and any username or password you create.
- Accident information: date, time, and location of the accident; a description of what happened; vehicles and parties involved; photographs and other files you upload; and any report or case numbers you choose to give us.
- Insurance and claim information: insurer name, policy or claim numbers, coverage details, and correspondence you choose to share.
- Payment information: if you ever make a payment to us, card and billing details are collected and processed by our third-party payment processor. We do not store full card numbers.
- Communications: the content of messages, emails, and calls with us.
Information collected automatically. When you use the Services, we and our analytics and advertising partners may collect your IP address, device identifiers, browser type, operating system and settings, pages viewed and links clicked, referring and exit pages, time spent, approximate location derived from IP address, and information collected through cookies, pixels, and similar technologies.
Information from others. We may receive information about you from participating attorneys and service providers, from advertising and marketing partners, and from analytics providers.
4. Recorded Calls
Florida law requires the consent of all parties to record a communication. We may record or monitor telephone calls with you for quality assurance, training, and recordkeeping. You will be told at the beginning of any recorded call. If you do not consent, tell us and we will continue without recording, or you may communicate with us in writing instead.
5. Information We Do Not Ask For
We do not request medical records, diagnoses, treatment information, or other health information. Please do not send us health or medical information. If you include it anyway, we will treat it under this Policy and delete it on request.
6. How We Use Information
- To provide, operate, and improve the Services
- To connect you with participating attorneys and service providers at your request
- To communicate with you by email, text message, and telephone about your request, subject to Section 8
- To respond to questions and provide support
- To measure and improve our advertising
- To detect, investigate, and prevent fraud, abuse, and security incidents
- To comply with law and enforce our Terms of Service
- To create de-identified or aggregated information, which we may use for any lawful purpose
7. How We Disclose Information
Participating attorneys and service providers.
When you ask to be connected, we disclose the information you gave us, including your contact details and the facts of your accident, to one or more participating attorneys or providers so they can contact you. At the time we make the connection, we will tell you the city, town, or county of a bona fide office of the attorney. Once your information reaches them, their own privacy practices govern. We do not control them.
Service providers.
Vendors that host our systems, send email and text messages, process payments, provide support, and perform analytics may use your information only to perform services for us.
Advertising and analytics partners.
These partners use cookies and similar technologies to measure our marketing and to serve advertising on other sites and apps.
Legal and safety.
We may disclose information to comply with law and legal process, to enforce our agreements, and to protect the rights, property, or safety of any person.
Business transfers.
Information may be transferred in a merger, acquisition, financing, or sale of assets.
8. Calls, Texts, and Emails
By submitting your telephone number you give your prior express written consent for Crash.Help and the attorneys and service providers we connect you with to contact you at that number by telephone call and text message, including through an automated system for the selection and dialing of telephone numbers and prerecorded or artificial voice messages, about your request and related services.
Consent is not a condition of any purchase or of receiving any service. Message and data rates may apply and message frequency varies. Calls and texts will be made only between 8:00 a.m. and 9:00 p.m. local time.
You may stop text messages at any time by replying STOP, and get help by replying HELP. We will stop within 15 days of receiving your request and may send one message confirming receipt. You may opt out of marketing emails using the unsubscribe link. Opting out of marketing does not stop transactional messages about a request you already submitted.
Revoking consent as to Crash.Help does not revoke it as to an attorney or provider you have already been connected with. You must contact them directly.
9. How We Make Money, and Sale and Sharing of Personal Information
Participating attorneys and service providers pay us an advertising fee. You pay us nothing. We receive no part of any legal fee and no part of any recovery. Participation is paid placement and is not an endorsement, certification, or evaluation of any attorney or provider.
Because we disclose your personal information to attorneys and providers in exchange for payment, and because advertising partners collect information through our site, these activities may constitute a "sale" of personal information or "sharing" for targeted or cross-context behavioral advertising under the privacy laws of states other than Florida.
The categories involved are identifiers and contact information, commercial information, internet and network activity, approximate geolocation, and the accident and insurance information you provide.
Recipients are participating attorneys and providers, service providers, and advertising and analytics partners.
You may opt out. Use the "Do Not Sell or Share My Personal Information" link on our site or the contact details in Section 12. We honor opt-out preference signals, including Global Privacy Control, as an opt-out for the browser transmitting the signal. We do not knowingly sell or share the personal information of consumers under 16.
10. Cookies and Tracking
We use cookies, pixels, and similar technologies to operate the site, remember preferences, measure traffic, and support advertising. Most browsers allow you to refuse or delete cookies, though parts of the Services may not work properly if you do.
11. Your Choices and Rights
A note about Florida law. Florida's comprehensive privacy statute, the Florida Digital Bill of Rights, applies only to businesses with more than $1 billion in global annual revenue that also meet additional platform criteria. Crash.Help does not meet that threshold, so the statute does not give Florida residents rights against us. We extend the following rights to all users anyway, as a matter of policy.
- Know and access the personal information we have collected about you, including categories, sources, purposes, and recipients
- Correct inaccurate personal information
- Delete personal information we collected from you
- Obtain a portable copy of information you provided
- Opt out of the sale or sharing of your personal information and of targeted advertising
- Be free from discrimination for exercising these rights
How to make a request. Email support@crash.help. We verify identity before responding, which may require confirming information already in our records. An authorized agent may act for you with written permission and proof of identity.
Timing. We respond within 45 days and may extend once by 45 days with notice.
Appeals. If we deny a request, write to support@crash.help with the subject line "Privacy Appeal." We respond in writing within 60 days. If we deny the appeal, you may contact the Florida Attorney General or your own state attorney general.
Limits on deletion. We may keep information we are required to retain by law, and information needed to complete a transaction, prevent fraud, or defend legal claims. We cannot delete information already transmitted to an attorney or provider at your request. Contact them directly.
12. Retention
We keep personal information for as long as needed to provide the Services and to satisfy our legal, tax, and recordkeeping obligations, and to establish or defend legal claims. Our general retention period for accident inquiry records is 4 years, after which records are deleted or de-identified.
13. Security
We maintain administrative, technical, and physical safeguards designed to protect personal information, consistent with the reasonable measures required by Fla. Stat. § 501.171. No system is perfectly secure and we cannot guarantee the security of information transmitted to us.
If a breach of security affecting your personal information occurs, we will notify you as required by Florida law, generally within 30 days after determining that a breach has occurred, and will notify the Florida Department of Legal Affairs where required.
14. Children
The Services are intended for adults 18 and older. We do not knowingly collect personal information from children under 13. If you believe a child has given us information, contact support@crash.help and we will delete it.
15. Third-Party Sites
The Services link to sites we do not control, including those of participating attorneys and providers. This Policy does not apply to them.
16. Changes
We may update this Policy. Material changes will be posted with a new effective date and, where required, additional notice. Continued use after the effective date constitutes acceptance.
